Tire Dealers and Collection Centers May Now Charge for Waste Tire Costs

Collection Cost and Fees
Beginning July 1, Arkansas tire dealers, other tire generators, and public collection centers may charge customers for the cost of waste tire collection, transport, and processing. New fee charges will be in addition to the collection and remittance by tire retailers to the state of the $3 per tire rim removal fee.
 
Exception:
When removing an old tire and replacing it with a used tire, dealers may only charge the customer $1 per tire. The $1 per tire fee is also remitted to the state. No additional fees may be charged to the customer when replacing an old tire with a used tire.
 
Davis Rubber Co. Fees
Davis Rubber Co. holds the contract with District 2 for collection, transport, and processing of waste tires. The new tire program law allows Davis Rubber Co. to collect additional fees to cover total costs. Likewise, tire retailers and public collection centers may charge additional fees to cover their costs.

The per-tire fees charged by Davis Rubber Co. will be as follows:

 
  • Small (example: passenger and pick-up truck tires) $2
  • Large (example: 18-wheeler truck tires) $2
  • XL (example: farm implement tires) $15
  • XL (example: industrial, heavy construction, mining, timber tires) $275 per ton.  These larger/heavier XL tires will not be accepted at collection centers, they must be delivered to Davis Rubber Co.’s processing facility in Little Rock.

Tire districts are no longer required to maintain a public collection center in every county. The current locations for District 2 collection centers are as follows:​​​​

Collection center locations may change upon determination of each proposed collection center’s staffing, collection of fees to be remitted to Davis Rubber Co. transporters, correctly counting of all deposited tires by category, supervising tire loading in trailers, and properly filling out and submitting manifests.


Collection Center Trailers and Fees

Collection centers may now charge a fee for collecting waste tires. Collection centers will charge different fees depending on cost. PLEASE CONTACT THE CLOSEST COLLECTION CENTER TO DETERMINE THEIR ADDITIONAL FEES. All collected waste tires must be accompanied by a manifest.

Payment for the additional fees will be due when the tires are brought to the collection center.  No cash will be accepted.  Payment must be made via check or credit card.  Please contact the closest collection center to determine which form of payment will be accepted.

Tires delivered to collection centers must be properly loaded as far forward as possible into 53’ trailers located at the site. Davis Rubber Co. will provide collection center trailers and transport from the collection center to the Davis processing facility.

Tires delivered directly to Davis will not require loading or delivery in 53’ trailers.

What Counties Are in District 2?
The District 2 Waste Tire Accountability Program is one of four waste tire districts in Arkansas. District 2’s service area consists of 27 counties: Clay, Cleburne, Craighead, Crittenden, Faulkner, Fulton, Greene, Hot Spring, Independence, Izard, Lawrence, Lee, Lonoke, Mississippi, Monroe, Poinsett, Prairie, Pulaski, Randolph, Saline, Sharp, St. Francis, Stone, White, and Woodruff.

Collection centers (current locations, above) accept waste tires from tire retailers/generators who have a valid Waste Tire Number (WST#) from the Arkansas Department of Finance and Administration (DF&A) and conduct business in the District 2 service area. (See map.)

The purpose of collection centers is to adequately serve the waste tire program area. The district’s contracted processor, Davis Rubber Co., will locate 53’ trailers at each collection center site. Waste tires must be properly loaded, as far forward as possible, and stacked or interlaced in the trailers to maximize capacity. Davis Rubber Co. will schedule pick-ups and transport and recycle waste tires at their Little Rock processing facility in. Collection centers also accept, at no charge, up to four (4) small or large waste tires per month from individuals living in the service area. Waste tires from the public must be off the rim. Documentation including name, address, and number of tires will be required by collection centers when disposing of waste tires.

Individuals disposing of more than four (4) tires per month will be required to pay a minimum of $4 for Small tires (example: passenger and pick-up truck tires), $10 for Large tires (example: 18-wheeler tires), and $25 for agri-related XL tires.

How do I qualify for the program?
Tire generators are required by law to register their business with DF&A. Registration will include a procedure for registering with the Division of Environmental Quality (DEQ) to obtain an identifying WST#. Tire generators include:
 
  1. Tire retailers
  2. Tire transporters
  3. Tire wholesalers
  4. Tire manufacturers
  5. New car dealers
  6. Used car dealers
  7. Auto repair shops
  8. Salvage yards

RIM REMOVAL FEES
When a tire retailer/generator registers with DF&A and receives a WST# from DEQ, they will qualify as a collector of the rim removal fee. Other fees to recover costs may be charged by retailers directly to customers.

When an old waste tire is removed from the rim and a new tire replaces the old tire, a $3 fee per tire is charged to the customer and remitted to the state. In addition to the $3 rim removal fee, customers may be charged by the tire retailer an additional fee per tire to cover costs for waste tire collection, transport, and processing for recycling.

Commercial Generators
COMMERCIAL GENERATORS
What is a commercial generator?
A commercial generator is defined as those who sell new tires as part of a fleet to the following:​
 
  • Municipality or County
  • State or Federal Agency
  • School District
  • Bulk Tire Buyer for Use of Commercial Vehicles
 
​The same fee schedule, above, will apply to commercial generators, in addition to the $3 state rim removal fee.

FEE PROCEDURE
The $3 rim removal fee shall be collected from the customer by the tire retailer and remitted to DF&A. (Remember: A WST# must be obtained by registering with DF&A and receiving a WST# from DEQ. WST#s are required to be listed on the manifests recording the number and type of tire removed from the rim for pick-up, transporting, and processing.)

However, to cover administrative costs, the tire retailer may retain five percent (5%) of the state’s $3 rim removal fee (or 15¢ per tire), plus additional fees required to cover costs, which are now allowed by the new law. Each tire retailer shall file a return with the DF&A on or before the 20th of each month. The return shall show the total rim removal fees collected for each new or used tire removed from the rim during the preceding calendar month. Additional fees the retailer may charge to cover costs are not required to be listed on the return filed with DF&A. 

Remember: Davis Rubber Co. and public collection centers may now charge fees in addition to the $3 rim removal fee (see Davis Rubber Co. fees, above). PLEASE CONTACT THE CLOSEST COLLECTION CENTER TO DETERMINE THEIR ADDITIONAL FEES.

Manifests
MANIFESTS REQUIRED
Manifests are required by law to accompany all waste tires removed from rims. The purpose of the manifest is to track all waste tires, used tires, and tires culled for resale, prior to collection, transportation, processing, recycling, and disposal.

Tire retailers and all tire generators are required to complete a paper manifest that records the name and location of the tire generator, the WST#, contact information, and the number of tires in each category being collected or delivered to Davis Rubber Co. 

Manifests must also accompany all waste tires being delivered to collection centers or otherwise collected by Davis Rubber Co. No waste tires shall be accepted without an accompanying manifest. The number of tires being loaded in trailers, or otherwise picked up for transport, or delivered directly to Davis Rubber Co. must match the number listed on the manifests.

EXTRA-LARGE TIRES
An extra-large tire (XL) is a waste tire that, due to its size and construction, is more difficult to collect, transport, and process than a small passenger or a large truck tire. 

XL tires include tires such as industrial, heavy construction, mining, a skid steer loader, excavation, heavy equipment, such as a road grader, timber and farm implement, backhoe, and a heavy-duty truck. An XL tire has a rating of “G” or higher.

Agriculture-related XL tires may be disposed of at collection centers for an additional fee of $15 per tire, plus collection center fees. PLEASE CONTACT THE CLOSEST COLLECTION CENTER TO DETERMINE THEIR ADDITIONAL FEES. 

Payment for the additional fees will be due when the tires are brought to the collection center.  No cash will be accepted. Payment must be made via check or credit card.  Please contact the closest collection center to determine which form of payment will be accepted.

However, larger industrial tires from heavy equipment, including forklifts, mining, and timber, must be delivered directly to the Davis Rubber Co. processing facility in Little Rock. Fees for these larger/heavier tires will be $275 per ton.
